Desertification Vote March/April 2023

WHAT IS A DECERTIFICATION PETITION?

A decertification petition is a vehicle whereby a group of employees in an established bargaining unit or an employee organization may bring about an election that allows employees to vote to either remove or replace their incumbent “exclusive representative.” (The “exclusive representative” is the employee organization that has been recognized or certified to represent the employees in the bargaining unit in their employment relations with the employer.)


THE OBJECTIVE OF A DECERTIFICATION PETITION

To terminate the union’s right to represent you and your fellow employees. This procedure provides you with full relief by taking away the union’s authority to act as your bargaining representative.  If you are a part of the employee union that is covered under a collective bargaining agreement (whether you are a union member or not) you can still sign a petition and participate in the decertification vote.  Once the union is removed as your legal bargaining representative you no longer have to join the union or pay dues or fees to it.


The SDEA Contract is Valid until June 30, 2023.  

Decertification Petition Must be filed between March 30th, 2023, and April 30th, 2023, and contain 30% of the signature of eligible voters.   The petition containing signatures of more than enough employees at Gompers Preparatory Academy will trigger a secret ballot election. The signature allows for a VOTE.


After the election trigger, In a few days, unit members will receive a letter from PERB letting them know of the process, and soon after a secret ballot that will give you three options.  One NO Representation (do not keep the SDEA as the exclusive representative), the Second is SDEA (Yes keep the SDEA), the Third is CARES (allow CARES to be the new Union for exclusive representation). We the parents, community members, and teachers of Gompers Preparatory Academy are asking you to vote NO Representation or CARES, thereby removing SDEA from GPA.


Next Steps:

1. Hold a secret ballot election. PERB then sets up a secret ballot election in response to the petition document. PERB will determine the appropriate group of people to vote in the election—a determination that unions and employers sometimes dispute, which can lead to delays in holding the election.  


2. Act in response to the results of the election. If 50% or more of the unit members vote against union representation, the SDEA will no longer have representation rights and the employees will once again be able to deal directly with the Leadership on issues related to pay, benefits, and working conditions.

  • GTA/SDEA support is waning- A DROP OF 87% since their inception  In 2018/19 they had approx. 60+ teachers in support of unionizing with SDEA, then in 2021 ONLY 21 voted for SDEA. In 2022 many SDEA supporting teachers left GPA. 
  • Gompers Teacher Association has lost most of its support,  only 1 of  the original 8 are left of the original group.  Why is this?  Because the SDEA can not solve their challenges in life.  SDEA only bargains Wages, Hours, and other terms and Conditions of Employment
  • SDEA/GTA can NOT Bargain JOY and Happiness!  JOY and HAPPYNESS was part of the GPA Family before SDEA, and now because of SDEA, it is gone.  BUT HOW?  JOY and HAPPYNESS is not a requirement at a place of employment, it exists because of the people that work there. JOY is NOT BARGAINABLE, Happiness comes within.  
  • in 2018 when GTA lied and brought division into the Family, that is when the JOY started to fade.  GTA is the reason for the lack of JOY.  GTA is the reason for DIVISION at GPA.  GTA MUST GO for JOY to return to GPA. 
  • GTA has only made it WORSE to be a staff, teacher, student, and family at GPA.  Teachers and Staff can still fix this and VOTE SDEA Out in 2022.
  • Parents called teachers and asked: "Why did you support SDEA," most said they do not like them, but did not want to lose the extra pay.  We asked "It's better or worse since you have an SDEA contract," All said it was worse teaching at GPA now, but the pay is better.  
  • Parents know GPA will be a much happier place to work without SDEA.  Almost all of the original supporting teachers and organizers are now gone, it's time to vote SDEA Out in 2023.

Decertification Vote - What you Need to Know

PAST Description of the Balloting (2021 Process) - might change for 2023 Vote:

All eligible voters shall vote by mailed ballot. On September 8, 2021, PERB will mail a ballot to the home address of each eligible voter. Along with the ballot, the eligible voter will also receive a Secret Ballot Envelope, a postage-paid return envelope addressed to PERB, and instructions for casting the ballot. Ballots must be received by PERB not later than October 4, 2021, in order to be counted in the official tally of ballots.


Employees will be informed by the Notices of Election that if they believe they are eligible to vote in the election and they do not receive a ballot by September 22, 2021, they may contact PERB and request a duplicate ballot. PERB will accept employee requests for duplicate ballots on September 22, 2021 only. Requests may be made only by telephone and between the hours of 8:30 a.m. and 4:00 p.m.; the telephone number will be displayed on the Notices of Election. PERB will accept collect calls for this purpose. PERB will accept a request for a ballot only from the voter himself/herself.

The majority support the Vote as this is the only HONEST way to move forward.  The Teachers Association mislead unit members in singing over their rights to the SDEA and had no idea what to do.  The SDEA created the Union Control on lies from the beginning did not have the support when the teachers found out about the UNION.  


SDEA We do NOT Accept YOU the way you are!!!  SDEA We do NOT Support YOU the way you are!!!  WE WILL NOT PAY ANY UNION DUES TO YOU!!!! This relationship has to START OVER, and base it on TRUST and HONESTY!  We the Teachers from Gompers Preparatory Academy have waited almost 3 years, and now we will have our Vote!

 "It takes a special kind of politician to attempt to take away the new rights of countless workers " as Lorena Gonzalez recently said in an interview, and she is that politician!  

Lorena Gonzalez expressed her concerns again, as she recently found out that teachers are not happy with the SDEA/CTA and sought assistance from the National Right to Work Foundation to file for a desertification vote.  She further accused the National Right to Work Foundation of  being an organization that "disenfranchised workers."  Lorena..... The teachers and unit members at GPA never had a vote.  For you use Assembly letter head to continually badger our school is unprofessional.  Where is your letter supporting the teachers and unit members that want a vote?

Freedom to negotiate - what works for you

"The SDEA Union" political bureaucracy is one size fits all and eliminates individual rights from negotiating their own Work Year Agreement!  Before "The SDEA Union" took over, each staff member had the opportunity to negotiate their own work year, however, the contract was ratified, and each lost all rights to negotiate.  The contract will be in effect for one year!   "The SDEA Union" 205 days work year agreement, has teachers being paid less than SDUSD teachers.  Teachers and Staff have an Opportunity to Vote to Remove SDEA as their representative, allowing them the freedom to renegotiate their pay and work year!

Did you know this was to create a SDEA Teachers Union?

Not all teachers at Gompers Preparatory Academy knew what was happening. Many found out after months of backdoor meetings among eight teachers with Union representatives.  Many thought they were signing a document to support our school and teachers, NOT a union document.  To our knowledge, the Teacher Union was not mentioned to anyone. For 3 months the 9 outsiders lied to us about creating a Union!

    • If you are considering Union membership, please take the time to become informed about where your money will go. It’s time that you join to support our efforts to improve our profession, our school, and Opt-Out. The San Diego Education Association is not a friend of Gompers Preparatory Academy and the community.  The SDEA is anti-public charter education. The SDEA has engaged in cynical actions that hurt our school and community.
    • Gompers Teachers Association with assistance from the San Diego Education Association circulated an EERA Representation petition during a stealth signing blitz to teachers and staff in classrooms and offices (most teachers were unaware this was to form a Union), no vote was needed (as the 9 teachers were able to persuade barely 51% of the teacher's sign by promising summers off and higher wages).  This one petition authorizes our teacher's and counselors' voices to were now exclusively represented by a 3rd party  San Diego Education Association/CTA/NEA), and under their Bylaws. This took away all individual rights to bargain.  Now the Anti-Charter Union San Diego Education Association/CTA/NEA, not just the SDEA is in charge!   On 11/13/18 (video: forward 37:28), the 9 organizers presented to the SDUSD Board of Education to ask for their support, in which Board Member Richard Barrera wrote this letter.  On January, 2nd 2019, PERB officially recognized the Exclusive Representative, and in an Email sent by the Gompers Teacher Association, it to confirms January 2nd, 2019.
    • SDEA and Teacher Lay-offs: " Teachers unions have generally argued that seniority is the only fair way to make the painful decision of who to lay off. But the result of “last hired, first fired” is that disadvantaged schools tend to be hit harder by layoffs."

    Top 6 Reasons SDEA must be voted out of GPA:

    1. SDEA is Anti-Charter, and Gompers Teachers Association agreed with SDEA Anti-Charter Legislation support in April 26, 2019, GTA newsletter pages 4-6. Learn more about the SDEA Anti-Charter movement in the SDEA PROPOSAL (crippling Charter Schools) to SDUSD demonstrating their Anti-Charter bias, red lines are SDUSD edits, you can see how SDEA truly thinks and wants to control every aspect of every school.  Teachers did not come up with that, the SDEA did.  That's what's happening at GPA now. Truth is SDEA/CTA/NEA has begun a campaign to organize charter schools, while continuing to challenge their existence. It is a well-known fact that CTA heavily funds the Anti-Charter movement in California, $1million a month. The key reason SDEA/CTA/NEA are Anti-Charter, they claim charter schools are "draining funds" from district schools, thus they want to "Limit Charter School Growth".  The SDEA/CTA/NEA will say they are not Anti-Charter, they are against for-profit charters (yet there are only 35 for profit charter schools in California).   The truth, California Charter Schools Association President said " CTA is promoting an extreme legislative package that ranges from denying charter public schools, no matter how academically successful, right to appeal to the county or state for renewal (AB 1505) to establishing a cap on charters statewide (AB 1506). The bills would cripple the potential of all California students to receive a quality public education. If that isn’t anti-charter, we don’t know what is."
    2. SDEA blocks reform (GPA 6 period day, teacher-supported, based on survey results and the voice of our teachers), SDEA sent GPA a “cease and desist” (see it here) preventing the 6 period day. SDEA could have done an MOU for 6 period day, or presented a “waiver of the right to bargain,” since a majority of teachers supported 6 period day. Instead the Union presented additional constraints along with the 6 period day that would have required additional bargaining beyond the 6 period day.  There was not enough time in order to prepare for master schedule, and the SDEA knew that. The SDEA sold us on the idea that this would be our union and we could run it how we wanted. Well, that hasn’t been the case here with the 6 period day. 
    3. SDEA is actively against Director Riveroll (SDEA rep met with the NAACP to try and prevent Director Riveroll from receiving NAACP award, Gompers Teachers Association also knew. GPA response Letter.) NAACP Awards Video. Its also a well-documented fact that the SDEA never supported Gompers ever become charter and did whatever they could to prevent it from ever happening, including having Director Riveroll removed before the charter was authorized in 2005. ("they ordered Bersin in a closed-door meeting to remove Riveroll from the principalship at Gompers and put him in a central office job mentoring other principals.").  
    4. SDEA promotes a strict pay scale, anti-merit. Be they exceptional or mediocre or lousy—incentivizing longevity and education, not performance.
    5. SDEA advised teachers wrong and tried to cause or attempt to cause Gompers Preparatory Academy to violate the Education Employment Relations Act.  Once the union was recognized, teachers and staff could no longer negotiate wages and the SDEA know this, yet still advised otherwise.  This was brought up at bargaining meeting and GPA sent a letter to SDEA to stop.  
    6. The SDEA has exacerbate negative interpersonal dynamics.  Since SDEA has been at our school, relationships have deteriorated and this huge divide is very awkward. Teachers have been pitted against leadership, yet both are essential in educating students.

    ASK and KNOW: 

    • The law does not require “full disclosure” by union organizers of all the facts needed to have a balanced view;
    • If and when a union contract goes into effect, all employees in the bargaining unit are covered, whether or not they signed a card or voted for the union (no “opting out” of the contract);

    ASK and KNOW (source): 

    • Unions raise the costs of education, thereby draining resources away from inputs that raise achievement.
    • Unions remove incentives for teachers to improve instruction – for example, by shielding ineffective teachers from dismissal and by tying salaries to seniority rather than merit.
    • Increased formalization as a result of unionization hampers principals’ ability to manage their schools.
    • Unions encourage distrustful relationships between teachers and principals.
    • Due to their political clout, teacher unions can block promising educational reforms that threaten union interests.
    • Teacher union strikes, or even their threat, disrupt instruction, lower morale, and damage community relations.


    Bargaining---------The truth about collective bargaining:
    ********The union, not the teachers and other employees, decides what to propose in negotiations;


    The parties must negotiate in good faith, but there is no time limit on how long it may take to reach agreement, and no requirement that an agreement actually be reached;
    The union may have made many promises (for instance, tenure), but it cannot guarantee any of them will come true.

    San Diego Education Association is not what teachers want at Gompers Preparatory Academy! 


    Risks of Negotiations There is no guarantee a union will obtain higher pay or better benefits. In fact, the union cannot guarantee negotiations will not result in a reduction of wages or benefits.
    SDEA History with Gompers: DURING THE FORMATION OF GOMPERS CHARTER MIDDLE SCHOOLS Representatives' from the  SDEA headquarters met with teachers and provided arguments against the conversion of Gompers to charter status, including the false claim that teachers would lose health and retirement benefits and the right to return to the district.  After the dust settled,  charter petitioners successfully obtained the approval of more than 50% of its teachers for it's charter petition (Gao 2005a)" Source: Is it wrong for us to want good things?     Unions – by definition – are institutionally motivated to maximize the number of employees, control and minimize work load and to eliminate accountability. Many teachers chafe under union-imposed limitations on performance. Additionally, collective bargaining agreements can stifle the innovation and flexibility in curriculum and school governance that attract students, and teachers, to charter schools in the first place.

    Union Control of Members Unions require members to obey their rules – under pain of trial and potential fines. A union will expect all its members to act and speak with one voice; dissent and individuality are discouraged. This also can extend to political activities beyond the workplace. In recent years, unions have increasingly pressured members to contribute and campaign for the union’s preferred political and social agenda.


    On the SDEA website: Examples of how they encourage pressure tactics at our school.  Our school was a happy family before the SDEA got involved.  What other tactics are they going to use to take apart the charter they never wanted in the first place?  


    Is SDEA breaching its duty of fair representation to the Teacher and Staff at GPA?   It is the obligation to represent all employees fairly, in good faith, and without discrimination.  Who did the SDEA represent when they Blocked the 6 period day?  Who did the SDEA represent when they met and acted in bad faith with the NAACP discrediting our Director and school?
    After knowing this, do you still want the San Diego Education Association to be your exclusive representative, even though they have caused more harm than good? Whose best interest does the SDEA have?

    • Similar Story from another charter school in San Diego "America's Finest Charter School" in October 2011, SDEA Newsletter touting their formation of a Union.  In less then 2 years the teachers realized the SDEA was a very bad idea for their charter school and voted the SDEA out.  (How A San Diego Charter School Beat The Odds)

     

    DO NOT PAY UNION DUES! Save $1,200 a year!

    NEW TEACHERS.... Yes YOU!! You DO NOT HAVE to join the SDEA Teacher Union! Just say No Thank You!

    GPA is Hiring 40+ new Teachers and Staff.  This is the MOST since 2005.  As a new teacher, just know, MAJORITY of teachers at GPA DO NOT pay Union Dues and you too should not pay.  Don't feel pressured or tricked. When approached, say "I will think about it."  Find other teachers that are not paying and talk to them.  Seek the information as to what teachers received this year for their $1,200.  You will hear  "Nothing".  In fact several were so disappointed, they tried to stop their membership dues!


    Save Money. 

    GPA Teachers earn less per year, than teachers a MTM and Lincoln! Thank the SDEA!

    Under the tentative 2022 Contract, GPA Teachers will be paid FAR LESS than teachers at MTM/LINCOLN who are on column 1 of the SDUSD/SDEA contract and an additional $4,000 less for BA+ and MA+!  Gompers Teachers Association and SDEA are poor representatives of Teachers at GPA.  They had 5 years to negotiate a comparable wage, and they FAILED!


    Every year after year, Teachers are paid less than teachers in the SDUSD.  This does not even account for the increased pay for a BA+  or MA +, which would mean teachers at GPA could be at an additional loss of up to $4,000+ for each step.


    For UNION paying members, the loss would be an additional $1,200 per year.  Teachers can Opt-out, and at least keep $1,200 per year in their pocket.


    2022 day rate GPA Teacher Pay VS SDUSD Pay. Any teacher on the salary scale and in their 4th year and beyond, negotiated by SDEA/GTA, is getting paid LESS than teachers at MTM/Lincoln daily, plus they have less security and more responsibility.


    SDEA touts a "5% increase" YET Inflation is 8.3% on top of already low wages.

    Not all teachers received an increase some did not receive any anything!  The SDEA negotiated those staff out of a raise.  Inflation is currently 8.3% thus SDEA actually negotiated a contract that reduces overall teachers buying power by 3%.  DO NOT BE FOOLED!!!!  This is not a competitive wage, and in some cases could be upto $20,000 per year for teachers with a MA. At least SDEA could have negociated to have at minimum what SDUSD offeres on column 1 of their salary table.  SDEA would have only needed to negotiate an additional $168,000 to be EQUAL with column 1 of SDUSD salary table.  Why was this not done for the great teachers at GPA?


    2022 SDEA Contract is BAD for Teacher and GPA

    The contract keeps 205 working days (9.1), however, puts all the extra learning time for students at the end of the year, thus shortening Winter and Spring Breaks.  This also forced school to start 2 weeks earlier on August 16th.  SDEA Accepted that.  Not all teachers received a raise.  Reduced from 24 pay checks to 22, causing trauma in teachers at GPA.  SDEA did not even care, and still encouraged teacher to ratify the contract.  This is a BAD DEAL for EVERYONE.... 

    No Flexibility

    The SDEA Contract does not provide flexibility for teachers.  Everything is spelled out including a 30-minute lunch.   No Flexibility for the work year.... in the past teachers that needed time off in the summer were allowed to change the work-time to other times in the year.  Now that is not possible.  No flexibility for pay, or increase pay.  No merit pay.  No pay for the experience. No pay for going above and beyond.  The New Salary.... Teachers at GPA are the Lowest Paid in SDUSD District E.

    There is HOPE ...... PLEASE Vote SDEA OUT in April 2023!
